Mutual Funds Act
The Cayman legislation governing the registration and regulation of open-ended funds with CIMA.
The Mutual Funds Act is the Cayman Islands legislation that regulates open-ended funds; those whose investors may redeem their interests at their option. It sets out the registration and licensing categories, the requirement to appoint a Cayman-approved auditor, and the obligations to file audited financial statements and annual returns. It operates alongside the Private Funds Act, which governs closed-ended funds; which regime applies depends principally on whether investors have redemption rights.
Classification and registration depend on the full statutory definition, the entity’s terms and applicable exclusions. Strategy labels alone do not determine the regulatory route.
