FATCA
The US-driven automatic exchange regime under which Cayman financial institutions identify and report US account holders.
FATCA (the US Foreign Account Tax Compliance Act) is implemented in the Cayman Islands through an intergovernmental agreement and domestic regulations administered by the Cayman Tax Information Authority. Cayman financial institutions; including most funds; must classify themselves, conduct due diligence to identify US reportable accounts, register where required, and file annual reports. FATCA obligations run in parallel with the broader Common Reporting Standard (CRS). Failure to maintain FATCA and CRS compliance can result in enforcement action and penalties.
